ARTICLE 1 – PURPOSE OF THE GENERAL TERMS AND CONDITIONS OF SALE
In the context of the sale of products by IRIS GALERIE, these General Conditions of Sale (hereinafter referred to as "GTC") are intended to inform any potential Customer of the conditions and methods under which IRIS GALERIE proceeds with the sale and delivery of the ordered products.
The present CGV also determine the rights and obligations of the Parts (the term "Parts" includes the company IRIS GALERIE in its quality of Salesman and the Customer in its quality of Purchaser).
The GCS apply to all sales of products offered by IRIS GALERIE in our galleries but also on our website(https://irisgalerie.com/) and on our mobile application. Consequently, ordering a product offered for sale on the IRIS GALERIE site or in our galleries implies full and complete acceptance of these GCS, which the customer acknowledges having read prior to ordering.
These GTC also govern the use of the IRIS GALERIE mobile application, accessible via the App Store and Google Play download platforms.
The present GTC are completed by the General Terms of Use and the "Personal Data & Cookies" policy.
ARTICLE 2 - IDENTITY OF THE COMPANY
IRIS GALERIE is a simplified joint stock company with a share capital of 1,358.50 euros, headquartered at 60 rue de la Boétie in PARIS (75008), registered under number 897 514 618 with the PARIS Trade and Companies Register.
ARTICLE 3 - FORMATION OF THE SALES CONTRACT
3.1 - Proposed concept
IRIS GALERIE proceeds to photographs of the iris carried out by a shooting of the eye of the Customer. This photograph is then recovered with an aim of transforming it into work of art according to the various supports proposed to the Customer.
The shooting requires that the Customer goes to one of our galleries. The Customer can locate a point of sale from the "Galleries" tab available on our Site. Thus, we ask that each person be present in the gallery to take the photographs of the irises.
3.2 - Products offered
The products proposed by IRIS GALERIE are the following:
- Prints with printing on photo paper that the customer collects on site in the gallery on the same day;
- Acrylic glass or aluminium composite panel supports that can be delivered to the customer's home or to a gallery;
- Digital formats in HD transmitted to the e-mail address, which must be provided to the consultant by the Customer. By choosing this type of support, any printing or other use will be done by the Customer himself. In case of loss of the digital file, the Customer can ask the gallery where the purchase was made to return the file within 3 months upon presentation of the receipt. After this period, no more files will be sent. Moreover, the use of the digital file is exclusively intended for personal use, any commercial use is not authorized.
- Jewelry incorporating the customer's iris is made to order. They are produced and shipped within an estimated time communicated at the time of order.
- Light Boxes consist of a rigid box and LED lighting. Available in several formats/colors, they are produced and dispatched within an estimated timeframe communicated at the time of order. Their installation requires a specific connection (see usage appendix in CGU).
- Acrylic Blocks are acrylic glass blocks with a representation of the Customer's iris.
The company IRIS GALERIE can also develop any other personalized support in the future.
The sizes available in the gallery range from 15 cm to 180 cm wide, with square, rectangular, in-line or rounded formats.
Depending on the format chosen by the Customer, the latter will have the option of including several irises (solo, duo, trio, quartet, quintuor, or more on special order with quotation). Depending on the media chosen by the Customer, supplements will be offered to complete the order, such as :
- Classic frames for photo prints;
- US "classic" or "plus" cases for professional prints in Alu Dibond or Acrylic.
3.3 - Pricing
The sale prices of the products, in force at the time of the placing of the order by the Customer, are consultable on the Site then in the galleries of IRIS GALERIE.
The selling prices of the products can be modified by IRIS GALERIE constantly. This modification will be announced to the Customer before any order.
These prices do not include shipping costs, which are invoiced in addition to the price of the products purchased. Shipping costs will be indicated before the Customer places the Order. Only products delivered to the Customer's home require the payment of shipping costs.
The Customer can place order either in gallery, or via Internet site or the mobile application of IRIS GALERIE.
A price list is available on the Site in the "FAQ" section under "Practical information".
The prices include the tax on the added value (VAT) applicable to the day of the order. Any change of the applicable rate of VAT will be automatically reflected on the price of the products sold by IRIS GALERIE.
Moreover, the various methods of forwarding are envisaged in the present GCS with Article 6 and are also mentioned on the Site. They can be modified constantly by IRIS GALERIE.
Also, IRIS GALERIE advises any Customer to regularly consult the CGV appearing on the Site.
ARTICLE 4 - INFORMATION ON GALLERY HOURS
Opening and closing times are specific to each gallery. It is therefore the customer's responsibility to find out about opening and closing times.
Schedules are available on the IRIS GALERIE website by clicking on the address https://irisgalerie.com/, under the heading "Gallery", providing a visual overview of all existing galleries.
These times are subject to slight last-minute changes (public holidays, exceptional constraints, etc.). We recommend that you consult the online information regularly or contact the gallery concerned directly.
ARTICLE 5 - METHOD OF PAYMENT
5.1 - General information on the payment method
The payments in bank card and cash are the only means of payment accepted for the majority of the galleries of IRIS GALERIE.
However, franchise partners may offer different payment methods.
5.2 - Accepted credit cards
The following credit cards are accepted on the Site and in the gallery: Carte Bleue, Visa, Mastercard.
American Express is excluded.
5.3 - Gift card
IRIS GALERIE offers two types of gift cards:
- The material gift card;
- The dematerialized gift card.
The conditions of use of these two types of gift cards are identical.
The user of the gift card must go to the gallery to make a purchase.
Indeed, the IRIS GALERIE gift card must be obligatorily used in gallery in only one time, which can be possibly supplemented by another means of payment accepted by IRIS GALERIE if the amount of the order is higher than the initial amount of the gift card.
The gift card cannot be used to purchase other gift cards.
The gift card can only be used in the territory in which it was purchased. For example, a gift card purchased in France is only valid in France and a gift card purchased in Italy is only valid in Italy.
However, certain franchised galleries do not take part in the program of gift cards. You can contact the gallery by email or by telephone beforehand in order to check if it uses the gift cards IRIS GALERIE.
The validity of the gift card is effective from the date of purchase for a period of 1 (one) year. After this period, the gift card can no longer be used.
In addition, no replacement or refund is made for the purchase of a gift card, even if the card is lost or stolen.
5.4 - Terms of payment
All orders are subject to payment.
Consequently, IRIS GALERIE reserves the right to suspend or cancel any execution of an order in gallery and/or delivery, whatever its nature and level of execution, in the event of non-payment, of fraud or attempt at fraud relating to the use of the Site of IRIS GALERIE or order carried out within our galleries.
ARTICLE 6 - RETENTION OF TITLE
IRIS GALERIE remains holder of the good as soon as the payment is not finalized in its totality by the Customer.
ARTICLE 7 - METHOD OF DELIVERY AND RECEIPT OF THE ORDER
7.1 - General information
Products ordered by the Customer in accordance with these GTC shall be delivered to the address indicated by the Customer as the delivery address on the relevant order (hereinafter referred to as the "Delivery Address").
IRIS GALERIE also proposes, for a selection of products, the delivery in gallery or at residence.
The prints are given in hand to the customer the same day of his visit in the gallery, no delivery will be made.
Only prints on acrylic glass or aluminum composite panels, jewelry and light boxes are eligible for delivery. IRIS GALERIE does not supply any hooks for mounting acrylic glass or aluminum composite panels. The customer is responsible for the choice of mounting.
The non-exhaustive list of countries eligible for home delivery is as follows:

Furthermore, since July 1, 2021, all purchases made outside the European Union are now subject to taxation. Thus, for any order shipped outside the territory of the European Union, customs charges will be the sole responsibility of the Customer.
7.2 - Confirmation of the order
The order is confirmed as soon as the payment is settled.
After having provided the elements used for delivery, the Customer will be allocated in gallery:
- A certificate of authenticity;
- A bank card ticket ;
- A summary of the order.
These tickets are to be kept by the Customer. They will constitute a proof of purchase and order.
7.3 - Delivery time
The overall lead time, including production and delivery, is around 15 working days from the time the order is placed in the gallery, for deliveries to European countries.
The rest of the countries outside the European Union generally require a longer delivery time, which can sometimes be longer than the time indicated.
Consequently, IRIS GALERIE reserves the right to have a more extended delivery period in order to take into account the destination and the size of the product ordered by the Customer being able to influence the duration of delivery.
The Customer is then advised to wait within the above-mentioned time limits before proceeding with any claim to the Customer Service.
7.4 - Delivery and reception of the order in the gallery
The delivery in gallery consists for the Customer or the recipient of the order to come to recover his ordered and paid parcel in one of our galleries eligible for the delivery.
To find out which galleries are eligible for in-store delivery, please consult the list on the IRIS GALERIE website.
The gallery in which the purchase was made by the Customer will be the same place serving the delivery if it accepts deliveries.
If necessary, the Customer may request delivery to a gallery different from the place of purchase of his order (with the agreement of the gallery concerned).
The Customer will be informed by electronic mail of the reception of his order in gallery on behalf of IRIS GALERIE. With reception of the electronic mail, the Customer has a 30 (thirty) days deadline to recover his parcel.
To pick up his order in a gallery, the Customer must go to the gallery chosen for this purpose, bring a valid ID and the physical or dematerialized receipt containing the summary of the order.
A third party, authorized by the Customer, may also collect the Order. To do so, this person must be in possession of his or her identity document, a copy of the identity document of the recipient of the order, a power of attorney drawn up by the Customer, as well as a copy of the order summary ticket.
At the time of the handing-over of the Order, the Customer or the person authorized by the Customer will have to sign the delivery form of the Order. This slip is worth proof of the delivery by IRIS GALERIE and reception by the Customer or the recipient of the Order of the ordered products.
No dispute relating to the delivery in itself is possible if the parcel appears like having been given, the register of IRIS GALERIE being taken as proof.
7.5 - Delivery and reception of the order at home
The Customer will be informed by email of the sending of the order and will receive a number of follow-up on behalf of IRIS GALERIE. The Customer will be held to proceed to the follow-up of his order. Thereafter, the notification of delivery will be carried out directly by the conveyor itself.
IRIS GALERIE resorts to services of carriers third and does its best to transmit the whole of information available to the Customer. For this reason, IRIS GALERIE cannot be held responsible for extended delivery times.
In case of absence of the Customer or the recipient of the order at the time of the delivery or in the absence of rescheduling the delivery of the order, the deliverer can deposit the order in a relay point.
No refund will be made for the payment of delivery charges if the carrier drops off the order at a relay point.
The order not recovered in relay point will be returned in laboratory. The customer can only request the return of a new order, so no refund will be made.
7.6 - Order anomaly
Given the value of the goods and their sensitive nature, the Customer or the recipient of the order is invited to check the apparent condition of the package and the products upon delivery.
In case of anomaly concerning the order, the Customer or the recipient of the order must follow the procedure mentioned in Article 7.7.
Failing this, the Customer or the recipient of the order will not be entitled to any replacement of the products in question.
7.7 - Procedure in case of anomaly of the order
It is up to the Customer or the recipient of the order to announce the damage and/or the lacks noted and to formulate all the complaints near the Service Customers of IRIS GALERIE by telephone with +33 (0)1 81 70 19 48 of Monday at Friday of 10h with 18h and to address an email to the following address: contact@irisgalerie.com
This email shall contain:
- A photo of the damaged area of the product;
- A picture of the receipt with the order summary.
Notification of incidents must be made within a short period of time and at the latest within 3 (three) working days from delivery.
The Customer service of IRIS GALERIE will be able to ask for any information relating to the identity of the Customer or the recipient of the order and to proceed to any useful checking on this occasion.
ARTICLE 8 - IRIS GALERIE RETURN POLICY
No refunds are possible due to the uniqueness of the product and the laboratory method of manufacture.
Only the return of a new order could be agreed in the event of damage caused with the product during the delivery or for all problems related to the delivery. IRIS GALLERY thus commits itself sending back your product to you.
The return of a new order provides for the same delivery time cited in Article 7.3 of these GTC.
ARTICLE 9 - CUSTOMER RESPONSIBILITY
9.1 - Legal capacity of the client
Before his order, the Customer declares to have the full legal capacity, which enables him to engage with the title of the present CGV. Consequently, IRIS GALERIE cannot in no case to be held to check the legal capacity of its visitors and customers.
Consequently, if a person not having the legal capacity ordered articles on the Site of IRIS GALERIE or in one of our galleries, its legal persons in charge would assume the whole responsibility for this order and would assume the price.
9.2 - Limitation of liability of IRIS GALERIE
IRIS GALERIE is not held responsible for the damage caused by the Customer or the recipient of the order. Indeed, the direct and indirect damage that they are foreseeable or not, caused at the time of the maintenance or the fixing of the support are the responsibility of the Customer.
No replacement of the product can be agreed.
For safety reasons, we do not recommend hanging art above a bed.

ARTICLE 11 - PROCESSING AND PROTECTION OF THE CUSTOMER'S PERSONAL DATA
IRIS GALERIE collects personal data of the Customer at the time of his passage in gallery as well as, if necessary, that of the recipient of the order.
All information relating to the collection and processing of data as well as the Customer's rights are set out in the "Privacy Policy" of the IRIS GALERIE website.
ARTICLE 12 - INTELLECTUAL PROPERTY RIGHTS
All the elements present on the site and the site itself are protected by copyright, trademark law, designs and models and/or any other intellectual property right.
By elements, we understand in a non-exhaustive way: photographs, images, drawings, illustrations, texts, videos, logos, brands, models, software...
These elements belong to the company IRIS GALERIE or are used with the agreement of their owners. As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or integral by some process and on some support that it is (paper, numerical...) are prohibited, without the preliminary written authorization of the company IRIS GALERIE, except the exceptions aimed at the article L122.5 of the Code of Intellectual Property, under penalty of constituting an offence of counterfeit of royalty and/or drawings and models and/or mark, punished by 4 years of imprisonment and 400.000 euros of fine.
ARTICLE 13 - APPLICABLE LAW AND JURISDICTION
The present contract of sale concluded between IRIS GALERIE and the Customer is subjected to the French right whatever the country of residence of the Customer and the place of placing of the Order. Any litigation relating to contract of sale concluded between the Parts will be of the exclusive competence of the French courts.
ARTICLE 14 - DURATION OF THE GSAS
IRIS GALERIE reserves the faculty to modify constantly the present CGV. However, the CGV applicable to the sale contract are those accepted by the Customer at the time of the placing of the order.
ARTICLE 15 - WARRANTIES
Duration and General Conditions
IRIS GALERIE offers a 1-year commercial warranty from the date of purchase on :
- The jewels
- Prints on acrylic glass or aluminum composite panels
- Light boxes
The warranty applies in the event of a manufacturing defect identified by customer service, subject to presentation of proof of purchase and proper use.
Warranty exclusions
Not covered:
- Accidents, impacts, crushing, improper handling
- Exposure to corrosive substances or environments
- Normal wear and aging of materials
Terms of use
In order to benefit fully from the warranty, the customer must respect the best practices for use of each type of product. These instructions are detailed in the "Conditions of use" appendix attached to these General Sales Conditions (GSC).
Failure to comply with these recommendations may invalidate the warranty.
Appendix - Terms of Use
For jewelry
Avoid contact with :
- Perfumes, cosmetics, household products
- Salt or chlorinated water (rinse with fresh water after swimming)
- Store away from moisture and corrosive agents.
For prints on acrylic glass and aluminum composite panels
Do not expose to :
- UV rays
- Heat sources (radiators, convectors)
- Humid environments (bathrooms, cellars, kitchens)
Handle with gloves to avoid scratches
Cleaning :
- Feather duster or soft cloth only
- No abrasive or stripping products
Mounting :
- Solidly anchored to weight and wall
Safety :
- Keep out of reach of children and pets
- Avoid falls
For light boxes
Instructions for use :
The Light box lights up with a single, short press of the button. A long, continuous press adjusts the brightness to your personal preference. The device retains the last brightness level used, and automatically restores it the next time it is switched on. For optimum performance, 40x40 models need to be plugged into a wall socket with 2.8 A of amperage, corresponding to a rapid charger.

Handling and care :
- Gentle dusting, no abrasive products
- Out of reach of children and pets

CGU
ARTICLE 1 - PURPOSE
The purpose of these General Conditions of Use (hereinafter the "GCU") is to define the terms of access, navigation and use of the website https://irisgalerie.com (hereinafter the "Site"), published by IRIS GALERIE SAS, as well as the respective rights and obligations of users and the Publisher in this context.
Access to and browsing of the Site implies the User's full acceptance of these GCU.
ARTICLE 2 - ACCESS TO THE SITE
Access to the Site is free of charge, subject to any Internet access charges, which remain at the User's expense.
The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure, events beyond the control of the Editor or maintenance operations necessary for the proper functioning of the Site.
ARTICLE 3 - INTELLECTUAL PROPERTY
The entire Site and its contents (texts, visuals, photographs, videos, illustrations, logos, graphic charters, icons, software, databases, etc.) are protected by the French Intellectual Property Code and remain the exclusive property of IRIS GALERIE SAS or its partners.
Any reproduction, representation, distribution, adaptation or exploitation, in whole or in part, without prior written authorization, is strictly prohibited and may constitute an act of counterfeiting.
ARTICLE 4 - PERSONAL DATA
Personal data collected via the Site is processed in accordance with the Privacy Policy.
In accordance with the General Data Protection Regulation (GDPR), the User has rights of access, rectification, deletion, opposition, limitation of processing and portability of their personal data.

ARTICLE 5 - COOKIES AND TRACERS
The Site may use cookies and other tracers for technical (proper operation of the Site), analytical (audience measurement) or advertising purposes.
On the first visit, an information banner allows the User to accept, refuse or configure the use of cookies according to their purpose.
For further information, the User is invited to consult the Cookie Policy accessible from the footer of the Site.
ARTICLE 6 - OBLIGATIONS OF THE USER
The User undertakes to :
- Use the Site in accordance with the laws in force and with these GCU;
- Do not attempt to gain fraudulent access to protected areas (third-party accounts, back-office, databases, etc.);
- Not to hinder or disrupt the proper functioning of the Site;
- Not to infringe the rights of third parties or the security of the Site.
In the event of violation of the present GCU, IRIS GALERIE reserves the right to restrict or suspend access to the Site, without prejudice to any legal action.
ARTICLE 7 - LIABILITY
IRIS GALERIE uses all reasonable means to ensure reliable and continuous access to the Site.
However, the company cannot be held liable for any damage:
- In the event of temporary interruption for maintenance, updating or force majeure ;
- In the event of malfunction, breakdown or technical incompatibility affecting the User ;
- In the event of inappropriate or illicit use of the Site by the User.
ARTICLE 8 - AMENDMENTS TO THE GGU
IRIS GALERIE reserves the right to modify the present GCU at any time.
Updated versions will be published on the Site, with the corresponding update date. The User is invited to consult this page regularly.
Continued use of the Site constitutes acceptance of the amended GTC.
ARTICLE 9 - APPLICABLE LAW AND JURISDICTION
These GCU are governed by French law.
In the event of litigation relating to the interpretation or the execution of the present GCU, the courts having jurisdiction will be those of the jurisdiction of the registered office of IRIS GALERIE SAS, except imperative legal provision contrary.
